Elgin Criminal Cases

Elgin is part of the Kane County 16th Judicial Circuit. All Elgin criminal cases are prosecuted by the Kane County State’s Attorney’s Office. The Kane County State’s Attorney’s Office is located on the third floor of the Kane County Judicial Center, which is located at 37W775 Illinois 38 in St. Charles, Illinois. All Elgin felony cases are heard at the Kane County Judicial Center. All Elgin felony cases are heard on the third floor of the Kane County Judicial Center.

All Elgin Bond Hearings are held at the Kane County Judicial Center at 8:30 a.m. and at 3:30 p.m. in the lower level of the building in Room 005. Weekend and holiday Bond Court hearings are also held in the basement of the Kane County Judicial Center. The Kane County Jail is located next to the Kane County Judicial Center.

All Elgin misdemeanor cases, such as Elgin DUI cases, Elgin Retail Theft cases, Elgin Battery cases, Elgin Drug cases, and Elgin Theft cases are held on the 2nd floor of the Kane County Judicial Center in St. Charles.

All Elgin Preliminary Hearing cases are held in Room 319 of the Kane County Judicial Center. If a case is not resolved in room 319, the case will be assigned to another felony courtroom on the third floor.

Elgin has a Kane County Branch Courthouse at 1500 Dexter Court, Elgin, Illinois. The Elgin Branch Courthouse mostly hears Municipal Ordinance Violation cases and traffic ticket cases. Some cases at the Elgin Branch Courthouse while Municipal Ordinance cases are prosecuted by attorneys working for the municipality. The Elgin Branch Courthouse also has Bond Hearings during the week for people arrested in Elgin, Carpentersville, South Elgin, East Dundee and West Dundee. Bond Hearings at the Elgin Branch Courthouse are at 8 a.m. over a video feed. Elgin weekend and Holiday Bond Court hearings are held in Room 005 of the Kane County Judicial Center.

Elgin Domestic Battery cases are held all day in Room 209 of the Kane County Judicial Center. Room 209 is a Courtroom in Kane County that only handles Domestic Battery cases in Kane County.

All Elgin felony DUI cases are heard at the Kane County Judicial Center. Most Elgin misdemeanor DUI cases are also at the Kane County Courthouse. However, Elgin is one of the cities that have elected to prosecute certain misdemeanor DUI cases through the City of Elgin rather than the Kane County State’s Attorney’s Office. While the Kane County State’s Attorney’s Office continues to monitor the prosecution of all Elgin misdemeanor DUI cases, the prosecutor handling the Elgin DUI case is a City Attorney who works for the City of Elgin and not for the Kane County State’s Attorney’s Office.
