Under 720 ILCS 570/402 is against the law in Illinois to knowingly possess a controlled substance. The police do not have to retrieve the drugs from you. When the police find the drugs on you, that’s called actual possession. But when the police find the illegal drugs inside of your vehicle, or in your house, or your bedroom, that’s called constructive possession. In both cases the state has to prove that you had knowledge of the Controlled Substance or illegal drugs and that they were under your control.

What Are the Penalties for Possession of a Controlled Substance in Illinois?
